SINTON – Sinton local and owner of the Sinton Feed Store, Donna Thomas, 52, turned herself in to authorities at 7:18 a.m. on Thursday, July 31 at the San Patricio County Sheriff’s Department.

Thomas is being charged with four counts of misapplication of fiduciary property and two counts of felony forgery, all state jail felonies, in association with the Fallen But Not Forgotten Scholarship Fund, a fund that was set up in honor of a U.S. Marine from Sinton.

A waiver of arraignment was submitted by Thomas’ attorney, John Gilmore on Aug. 1, in which Thomas entered into a plea of not guilty, requested a pretrial and jury trial on the matter and waived the right to be present at the arraignment, scheduled for 8 a.m. on Thursday, Aug. 7.

“The grand jury felt there was enough evidence to warrant a public trial,” District Attorney Michael Welborn commented. Thomas’ case will be one of 29 heard during Thursday’s arraignment.

As of press time, Thomas and her attorney, Gilmore, were unavailable for commenting.

The alleged charges are shown to have occurred between June and December 2012, according to the indictment report filed July 16, and are as follows:

• Count 1 (Misapplication of Fiduciary Property) - Check written on or about July 24, 2012, in the amount of $1,962.80.

• Count 2 (Misapplication of Fiduciary Property) - Check written on or about July 19, 2012, in the amount of $2,984.92.

• Count 3 (Misapplication of Fiduciary Property) - Check written on or about July 23, 2012, in the amount of $2,795.00.

• Count 4 (Misapplication of Fiduciary Property) - Savings withdrawal on or about Aug. 1, 2012, in the amount of $2,319.78.

• Count 5 (Forgery Financial Instrument) - Check, dated Dec. 3, 2012, in the amount of $4,300.00.

• Count 6 (Forgery Financial Instrument) - Check, dated June 18, 2012, in the amount of $1,500.00.

Thomas was released from custody of the SPC Sheriff’s Department at 10:32 a.m. the same day on a $5,000 bail.
