Grand jury returns capital murder indictment against Butler

GOLIAD – A Goliad County grand jury returned a capital murder indictment Tuesday against Spencer Clay Butler in the death of a 9-month-old Goliad infant.

Butler, 32, is charged with capital murder in the death of Paul McAdams and could face the death penalty. According to the indictment, Butler did "intentionally and knowingly cause the death of an individual, Paul McAdams, by causing trauma to the head of the said Paul McAdams by striking the said Paul McAdams with an object; and by striking the said Paul McAdams against an object; and by means unknown to the Grand Jurors, and the said Paul McAdams was then and there an individual under 10 years of age."

Butler was staying at the home of the infant's parents, Marilyn Weygand and Zachary McAdams, when the child was transported from Goliad to Victoria's DeTar Hospital in the early morning hours of April 4. The infant was transported to a San Antonio hospital where he died. The autopsy report said the child died from blunt force trauma to his head.

The child's two siblings, ages 5 and 8, were removed from the home by Child Protective Services and are living with a relative. No charges have been filed against the child's parents.
