Prison inmate charged in 2008 murder

BEEVILLE – A 33-year-old offender who was doing time at the Texas Department of Criminal Justice’s William G. McConnell Unit in Bee County has been transferred to the Bexar County Jail to answer questions about a 2008 murder in that county.

Police said DNA evidence found on the body of 24-year-old Roxanne Diaz in April 2008 connected her to Gilbert Rico, the McConnell Unit inmate.

TDCJ officials confirmed that Rico was being held at the prison in what was termed a substance abuse punishment however, they had no information about the duration of his sentence or other details.

According to a report on file at the San Antonio Police Department, Diaz’s body was discovered by a man walking his dog in wooded area in the 3400 block of Magic Drive there on April 9.

The man told officers he noticed the body of a woman lying face down just off the walking trail. She was wearing a shirt but no pants, and there was blood around her head and upper torso.

The victim was later identified as Diaz. During the subsequent investigation, DNA evidence was discovered on the victim’s body.

The evidence did not match the victim’s. In February, investigators were able to match the DNA sample with Rico’s.

TDCJ Public Information Officer Jason Clark said all offenders booked into the state prison system must submit DNA samples.

The results of those samples are kept on file and are available to investigators.

Rico reportedly has told an SAPD investigator that he did not know the victim and that he never had sex with her.

However, after another DNA test, investigators were not able to exclude Rico as the source for the evidence found on Diaz’s body.

Detectives then obtained an arrest warrant and took him into custody late last month.
